1. Acceptance of Terms

By downloading, accessing, or using the NINE mobile application ("App") and website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App. NINE is operated by Pard Business Management & Consulting Ltd. ("Company", "we", "us").

2. MEDICAL DISCLAIMER (IMPORTANT)

NINE is a health logging tool designed to assist pet owners. It does NOT provide medical advice, diagnosis, or treatment.

All data logged in the App, including but not limited to weight, Body Condition Scores (BCS), symptoms, and behavioral observations, is based entirely on user input. The App's reference materials are for informational purposes only.

Always consult a qualified veterinarian for any concerns regarding your cat's health. Never disregard professional veterinary advice or delay in seeking it because of something you have read on this App. In the event of a medical emergency, contact your veterinarian or emergency animal hospital immediately.

3. User Accounts & Data

You may use the App without creating an account ("Basic Mode"), in which case your data is stored locally on your device. We are not responsible for data loss in Basic Mode if your device is lost, damaged, or wiped.

NINE Pro users may create an account to enable cloud synchronization. You are responsible for maintaining the confidentiality of your account credentials.

4. NINE Pro Subscription Terms

NINE Pro is offered as an auto-renewing subscription service that unlocks advanced features such as unlimited history, cloud sync, and PDF exports.

  • Pricing: $2.99 USD/month or $29.99 USD/year (prices may vary by region).
  • Billing: Payment will be charged to your Apple ID or Google Play Account at confirmation of purchase.
  • Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period.
  • Cancellation: You can manage or cancel your subscription in your device's Account Settings (Apple App Store or Google Play Store) after purchase. Refunds are subject to the policies of the respective app store.

5. Limitation of Liability

To the fullest extent permitted by law, Pard Business Management & Consulting Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

We specifically disclaim liability for any injury or health complication arising from reliance on the App's tracking features.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes. Continued use of the Service following any changes constitutes acceptance of the new Terms.
